Abstract:

The Mental Capacity Act allows restraint and restrictions to be used but only if they are in a person’s best interest. Extra safeguards are needed if the restrictions and restraint used will deprive a person of their liberty, such restrictions need to be assessed and authorised; this can only be implemented by the Local Authority or the Court of Protection. These are called Deprivation of Liberty Safeguards (DoLs). Article 5 of the Human Rights Act states that “Everyone has the right to liberty and security of person, no one shall be deprived of his or her liberty in accordance with a procedure prescribed in law”. The Deprivation of Liberty Safeguards is the procedure prescribed in law when it is necessary to deprive of their liberty a resident or patient who lacks capacity to consent to their care and treatment in order to keep them safe from harm.

II.2.4) Description of the procurement

The initial contract period will be 2 years (i.e. up to 2.2020) with the option to extend for up a further 1 year.

These services may be subject to other modifications and changes in order to meet the changing needs and demands of the Council and the customers. This may also be as the result of additional or reduced funding streams.

The Council will undertake its financial assessment of the tendering organisation (and if considered necessary by the Council, any partners within a consortium bid) based on its own evaluation of the tenderers" most recent 2 years accounts (or if 2 years accounts are not available, equivalent evidence which confirms financial viability). The assessment of accounts will be supported by an independent credit reference report from Credit-safe where this is available. The Council may also impose a Bond or Performance Guarantee on the successful Tenderer. Minimum level(s) of standards possibly required: Evidence as stated in the tender documentation.
